This is what my lawyer told me: besides the following, I asked a letter from my company to prove that I work for them, with my salary etc...
You should take a copy of the entire H-1B package which includes the H-1B
forms (1-129, and H Supplement), the letter we had submitted, Labor
Condition Application, your recent pay-stubs, all your tax returns,
education evaluation (if any was done). If you have a degree from this
country you should take your original degree, transcripts etc.
If you have always been on an H-1B please make sure that the salary on the
H-1B forms and the actual salary you have received are consistent.
I only have the original approval notice. From whom should I ask for the H1-B petition letter and the Labor Condition Application? From the Human Resource of my company or from my lawyer? Another question is about the salary. The salary on the application form is the total of the actual salary in my pay stub plus annual bonus at the end of each year. So the salary shown in my pay stub may be a little less than the salary indicated in the H1-B form without adding the annual bonus. Do you think the visa officers will accept my explanation mentioned as above? When making a judgment on the consistency of the salary,do they look for yearly or monthly salary? Please advise.
